Bee Cave City Council voted on Saturday morning (Feb 16th) to accept a calculation that the City has 5,000 inhabitants and to move ahead on a vote for Home Rule in the May election.

Basing their calculations on the 2010 census of 3,925 inhabitants with an average of 3.1 per household (except apartments and mobile homes) and the estimated number of houses and partments within the City limits now, the 5,000 was reached. State calculations usually use an average of 2.3 - leaving a loophole that may need to be defended if the Home Rule adoption is challenged in court.

A charter committee of 15 people is now working on refining the City's charter based on a template from Horseshoe Bay.

    Will only prospective members of the ETJ get to vote on this? I just want to clarify so I can update my change.org petitioners correctly.

    I think the city's registered voters may get to vote when an annexation is proposed. So people in the ETJ have no input, and I think Council can pass resolution without vote, too.

    This is really good news! We want to be a Home Rule city. I'm so glad this number exceeds 5,000 and that the city is working on the Home Rule charter sooner than later!

    Lindsay did a great job pulling together different statistics to prove her over 5k inhabitants. She used the same statistics used from the 2010 census. Our demographics here in Bee Cave are not the same as the average in Texas so using the Census statistic is more accurate. Becoming a Home Rule city is not only about annexing, it is about having power to regulate what gets built in our city. No, you can't say a business cannot be built, but you can make sure they follow the cities guidelines such as dark sky, noise ordinance, and safety! Please explain the negatives of why you would not want to become a Home Rule city if you live in Bee Cave. If you do not, why weren't you at the city council meeting this morning defending your views.

    According to Texas law:

    The City Council can approve placing a charter written by a commission on the ballot, but a plurality of Bee Cave city voters has to approve the charter. If voters don't approve it, it doesn't apply.

    ETJ folks cannot vote on this. Petitions, etc. by ETJ folks on this don't count. Texas' law would have to be changed. I suspect someone would question the legal wisdom and constitutionality of that kind of change.
