In what is widely expected to be the run up to a bid to get herself re-elected to Bee Cave City Council, Uplands resident and former Mayor Pro Tem Zelda Auslander has started a survey on quality of life and other issues in Bee Cave.

This May, Mayor Caroline Murphy as well as her husband Mike Murphy (rumored to be stepping down to work on the new Water authority instead) and Councilman Chad Bockius are all up for re-election. The key question is - will Zelda stand for Mayor or is that decision dependent on what Mayor Murphy does next?

Zelda told us: "After having the honor of serving on the Bee Cave City Council nearly 8 years, during the period of intensive planning and development for the City, I took a break from City business to explore living in Singapore and traveling Asia for nearly 2 years. I have now been back in Bee Cave over 1.5 years enjoying the community with a fresh and broader perspective, and great appreciation for how lucky we are to live here. My experience, passion, and time to dedicate to our community have recently been refueled by my renewed concern to first and foremost protect the interests of the RESIDENTS of our exceptional community.  I have developed a survey where I would really appreciate and value your input.  Please take the time to take the survey and pass this email and survey link along to your neighbors, family and others whose input would be helpful.

I promise this information will be shared frequently with the City."

    I've read your posts on Planet K. Curious if you are prejudice because owner is Jewish.

    It is very interesting that this survey structures itself around the Hill Country Indoor project. As a resident of Bee Cave for many years, I can't imagine the city not championing this project as the next best thing for this community. Although it seems there has been some hesitation!? I hope your intentions are pure Zelda. If so, my family and MANY others are with you.

    I had several projects and current issues in mind when designing the survey to gauge folks' thoughts to help compare or clarify against my own. I certainly didn't design the survey to advocate for or detract from any specific project currently before the city.

    It is important to understand that my interest in the City is genuine care about our community and how it turns out...I am a resident for over 14 years. Me nor my spouse (an AMD employee)have any financial gain whatsoever from my being elected to City Council...we don't own any commercial land and we are not commercial or even residential brokers. I don't accept any financial donations to my campaign, except stamps if anyone cares to share some as our number of homes has grown substantially over the years). I just enjoy it, I have time, and I care !

    Specifically on the Hill Country Indoor proposal, I think the project would be a huge benefit and perfect fit for our young, active, family-oriented, athletically talented community. The folks behind it, including Josh McKay, have done an outstanding job putting very talented plans and synergistic businesses together under one roof. My only concern which I've addressed with Josh AND HOPE TO FIND A SOLUTION FOR is the issue of setting a big-box legal precedent that can't be reversed. While this recreational use would be a huge benefit and amenity to our community, the concern is that a "large big-box retailer" would come in under legal precedent and wipe out our many small businesses that exist in our community...by under-cutting on prices through economies of scale (the other anti-bigbox issue is one of the community's character). Other than HEB and Dillard's, the other big boxes in the City such as Target, Lowe's, Home Depot were originally outside the city limits and agreed to annexation (a substantial financial benefit to the community when they could build anyway). Bottom line is I would like to see this project work...how to get it accomplished is fragile in my opinion.

    To set the record straight, I feel the need to respond to the Anonymous comments. While the ignorant winds of anti-semitism unfortuntely still exist, they don't blow with me because I AM Jewish!

    To allege I am against free enterprise completely distorts the truth...I am a consistent defender of Capitalism. My parents fled communist Cuba in 1961 and left EVERYTHING behind for the promise of economic freedom in the USA. But since its inception, this has been a country of laws...where FREEDOM IS NOT ABSOLUTE! Your rights end where mine begin !

    Planet K ASSAULTED Bee Cave from the very beginning KNOWINGLY and PURPOSELY Defying SEVERAL zoning laws(buying the property in secrecy for an unapproved use in that location, hanging unapproved murals in the middle of the night, renovating interior including electrical without a permit, and selling all merchandise on its porch). Its behavior attacks our City's sovereignty and rights of its citizens to determine the community's character via zoning as allowed by the Constitution. While I am not against the right for Planet K to exist (this comes after deep exposure to travel and living in Amsterdam, Singapore, etc), I do believe there is a time and a place for everything....and Bee Cave is Not the Place for Planet K !!!

    As for the No-Drive Thru Restaurants, the idea of turning Hwy 71 and 620 in Bee Cave into fast-food haven like Burnet Rd. does not appeal to me as a homeowner (McDonalds's and Chic-Fil-A are grandfathered). It defies the unique character and quality of life I personally seek for my surroundings. If a rush of fast food joints on our busy roadways don't diminish our citizens' residential property values, they certainly won't enhance them. A wise lady once said, "While every house needs a laundry room, you never locate it at the front of the house!" Now that's a more accurate representation of my belief and philosophy.

    Anything you have to say at this point about Planet K doesn't even matter. The court *ordered* The City of Bee Cave to let Planet K open. Yet the City of Bee Cave still has defied this court order. Nothing more needs to be said.

    Why do you seem to believe that you can speak for the entire city on "what Bee Cave is the place for"? Don't speak for me. Especially don't speak for the entire city. The previous polls on this site and the numbers of downvotes on your comment if anything, proves you in the minority. What you mean to say is "Zelda does not want Planet K here!".

    I personally know many people, family and friends who would use Planet K, and do who live in Bee Cave and this area. You seem to believe that no one in this city will go to this store. You're wrong.

    Planet K has defied no zoning laws and has no justification to be labeled an "adult store", as it sells no adult goods, such as sex toys. I dare you to show me another store in the Austin area, that sells the types of things that this Planet K in Bee Cave does/will. But that's right, you can't.

    You may *think* you're pro-capitalism/freedom. Most Americans do. However, the simple fact that you are against someone opening a store on THEIR OWN PRIVATE PROPERTY, assuming that no one in this area will visit it and trying to shut it down before it even opens, instead of letting it opening and letting the market decide if it should stay in business, shows that you are against some of the very basic principles of capitalism, as well as freedom. In fact, the idea of the government telling people what to do with their own private land screams "communist" to me.

    I hear people talk about "freedom from". Your "freedom from" is to not go to it if you don't want to! Having it in this city affects you in no way if you don't go to it. Your "rights end where mine begin" comment is about as ridiculous as someone saying "I don't like Mexican food! You're impeding on my freedom by opening a Mexican restaurant close to where I live!".

    If you think this is going to attract undesirables, you are wrong also. People from Austin are not going to come all the way to Bee Cave when they can go to a Planet K in Austin. All it will do is create a place where to people who already live in this area, who you meet every day, can go and buy things that they want.

    I certainly do not believe "no one would go to the store," and again, you are confusing freedom and the right to exist with legal zoning laws that were in place. I'm fortunately not in the minority on this one...Countless resident emails to the City and the room-full of residents against Planet K at the P&Z and Council meetings also believe Bee Cave Town Center is not the best place for Planet K to open shop. In the recent survey I put out to the community where I asked "Do you support spending tax dollars on litigation to defend our City's Ordinances, the intent of Bee Cave's Comprehensive Plan, and the sovereignty to choose how we portray and develop ourselves as a Community?," The results so far show overwhelming support for the city spending tax dollars to defend its ordinances (64% are Supportive and another 26% say Disappointed but Understandable)...Litigation continues and that is from a current elected Council that does not include me.

    If what you posted was the question on your survey, that's very misleading to what you were trying to ask and is in no way a good indication of what the city's opinion is on the matter on Planet K opening.

    Most people would say "yes", to a question like that, when not put into the correct context, including myself.

    A more appropriate question to ask to judge the city's opinion would be simply, "Do you support the opening of Planet K?".

    I do know though, that the poll on this website, that asked my recommended question, was in favor of Planet K opening.

    As for the emails and the residents at the meetings, sadly, those who oppose something are always more organized and spoken-up than those who support something. The fact that there are some who don't want to be labeled a "pot head", or something of the sort, may have to do with this also.

    From what I have read cities lose money by banning drive thru's , they just go to next closestcrown to McDonald's etc. Just losing revenue. But, if city plans on turning into snobville they should consider keeping housing prices high by building less. Less supply raises property values. I dont understand if city doesn't want non- elites why are they building for them. You're not being consistent.

    You bet the City would make a lot more sales tax revenues by allowing drive-thru restaurants. It's not always about the almighty dollar and fortunately the City is not in a desperate financial position to need to make that exception. The goal has been character, quality of life, preservation of homeowner values...not money, convenience, efficiency, etc. Lastly, the City doesn't build much. It's the private sector that has a right to build legal projects on property it owns. The City is not in a position to buy up all excess property for land preservation...but you're welcome to get others to do that if you wish to keep properties undeveloped.

    Since the laws' inception, Banks and Pharmacies are exempt from the no restaurant drive-thru policy. Bee Cave has tried to encourage privacy where it's needed and community interaction where it's preferred.

Lastly, I purport only to speak for myself but I do like to gauge the winds of public opinion (especially weighing from residents the kind that is generally void of personal financial gain and special interest). Bee Cave is our home first and foremost !

    I cannot comprehend how someone who labels themselves as a "fiscal" conservative disregards the revenue that businesses such as those with drive-thrus would bring the city. You claim the city need to be in desperate need of money to permit free market capitalism. It is clear that you mean to obstructing businesses such as Planet K using city ordinances which serve little more than as a barrier for economic growth which were created for social design. "Bee Cave Town Center is not the best place for Planet K to open shop." It is this type of liberal thinking that has led to fewer choices and higher prices. Hiding behind antiquated and socially engineered liberal laws is a tactic one would expect from a Kalifornian. You said, "it's the private sector that has a right to build legal projects on property it owns." And yet you block the private sector and hide behind obstructionist policies. Does not Planet K own the property? Should government chose the winners and losers? Why not let the consumer decide? It is apparent that you fear free choice by making sure there is no choice at all.

Please do not shame true fiscal conservatives with such ignorance. You preserve capital by bringing in new revenue, allowing for businesses to flourish by stepping aside, and reducing spending such as wasteful lawsuits which push an agenda as the previous administration had done.

    I advise anyone to read Friedman's positions on free market capitalism, monetary policies and more specifically deregulation. I'm looking at you Mrs. Auslander.

    Don't wear your heart on your sleeve. When creating questions for a survey it's important to mask any biases you may have.
    Asking loaded or leading questions can destroy your survey data & accuracy of your results. The objective of any survey is to get honest results on how respondents feel about survey topic.
    I agree with RK, your survey has many leading questions.
    If you really want accurate results remove the leading questions and/or words and replace them with unbiased ones.

    Zelda better than last time, I added some suggestions to your survey when space was provided, hopefully the 3rd time will be the charm and no intrusive or leading questions will be included.

    Why poll if you don't know where people view current city administration?
    You should include a question to rate the mayor, city council, municipal court and police. Can rate them 1-5, 5 being the best.

    #6. Should be one of the most important questions to you since you are running for a seat. You didn't include in the choices of city council members, mayor, municipal court or police department. Nice try escaping criticism.

    Zelda, many of the questions on the survey show your bias. This is especially true for question 9 which is more about your bias than wanting to inform yourself about what the citizens of Bee Cave really want. The answer, "Yes, but not in Bee Cave" should read "Yes, in Bee Cave". You already gave people the option of stating "No,not in Bee Cave". If we have drive-thrus for pharmacies and banks why not restaurants? Please explain the difference. The sound of voices is heard no matter what the business. At least at drive thru restaurants you don't have the added sound of tubes clanking through plastic and metal pipes.

    In hindsight, I agree 2 of the questions had a confusing set of answers, unintentionally. While I do have my personal opinions, I was seeking genuine input from folks without any intentional bias...I'm always open to changing my mind when being convinced otherwise. Sorry...I have no ill intentions or personal gain other than I really care to have the best for our community.
    Pharmacies and banks require privacy more afforded via drive thrus; they also aren't generally associated with "cheapening" an area like fast-food restaurants who cluster tend to do. We also want to encourage folks out here to slow down, meet and greet their neighbors at restaurants, coffee shops, etc. Pure free market would throw away the need for Urban Planning, Zoning laws, and most if not all governmental functions...not reasonable or the way our country was structured. Read more on many of my posts and replies above.

    Planet K is attempting to play the victim by ignoring sign ordinances that were in place when they moved here. They want to make this like the other stores I have seen (stasney & s lamar) which also has murals and "cactus cars" in front.These are junkers with the tops cut off,filled with dirt and Cactus.They are it's sign. They should course be exempted from rules applying to other business's in the name of freedom and because they are special.
    we should repeal all sign regulations and zoning,let freedom reign and trust the market to sort it out. I understand this has worked in other places.
