Planet K not guilty in directed verdict

In this week's much anticipated trial, local judge David Garza (himself a City employee) directed the jury to find a "not guilty" verdict in the criminal prosecution of Aus Pro (owners of Planet K) for erecting a mural without a permit at their future Bee Cave location.
Amid comments that the City's enforcement team had not inspected original deeds or reviewed definitions of "art" versus "signs" the judge effectively ruled against the City.
The trial, which lasted six hours, left even the jury foreman confused as to its necessity.
What happens next in the long running battle to prevent an "adult" store opening in the old Trading Post space on Highway 71 will be watched by all parties with interest.

I'm not a resident of this city. I thought Lakeway had issues. It may not be a village anymore but they still have lots of village idiots. Forget about the woopdedo galleria it's more eateries than shops anyway. If you want upscale shopping go to Domain & save yourself a traffic ticket too. Reading previous posts it looks like if you do 26 in a 25 you get a fine.

Instead of spending money trying to prevent a business that they think doesn't suit the neighborhood, why not let the market determine that. There are already numerous retailers that have come and gone just in the last couple years since the malls have been built. And we constantly here about decisions making it harder for them.
I remember when they wouldn't let Southwest Cyclesport use the sign they had been using for years one shopping center over, because it was inches oversize with the new mounting. And when Advanced Auto Parts opened in the old video store location, they made them take all their grand opening signs out of the windows, and wouldn't even let them change someone's windshield wiper blades out in front of the store without threatening a fine. Poor Sunflower complained that they couldn't get a decent sign out on the highway. Then there's the traffic tickets in the mall, how do they even get away with that? Isn't it private property on those drives?
Really, why not use common sense and help out new shops as much as they can, and let the retailer live or die on whether they have done their homework as far as demographics of the community. Instead of just claiming that something is against regulations, or even trying to make new rules specific to a new business, how about changing those laws to make the community more amenable to business growth.

2011-10-29 12:52:13 | DavidIt seems that the city was not prepared, this isn't a win for planet k so much as its a let's wait and see if the city refiles this case. In a directed verdict, the City is free to simply refile the case. Hopefully this time they take a little more care in making sure everything is correct. As we all know, success is normally found in the details. Personally, I don't like planet K nor do I like their look, but I do believe this on going battle is hurting the city and costing more money then it is worth. maybe it's time we allow the free enterprise system to work.
As for this last post by "Louise", it seems like it's the same old noise of let's hate the police. Let's blame the police for all that is wrong. Would you prefer if there was no police force? No one to enforce the laws that we voted for and supported when we voted into office the folks who wrote them? Let's stop expecting the police to turn a blind eye towards actual criminal violations ( traffic laws) because a few of our neighbors do not like them.....to suggest otherwise would be asking the men and women of the Bee Cave Police Dept and Lakeway Police Department to not do their jobs.

Anyone who believes they are above scrutiniy is contributing to corruption. Bcpd are looking for stalker that only comes out in daylight. Police have received numerous reports from people being followed & they have no leads or motives. They have been unsuccessful on several pursuits. Police are dumbfounded at this time. They call him "the shadow". Police believe he/she may strike again tomorrow.

2011-11-01 14:01:33 | DIVAGIRL - WAY TO GO PLANET K!Iam SO happy for Planet K for winning this one. I hope that Bee Caves had to shell out alot of money to get a lawyer to represent them in this case. Let the homeowners fees rise for covering the fees by taking this to court.
I own a local company and stores like Planet K support our business. I am VERY happy to see them opening new stores.
And for you fools that say its going to devalue your property values, your INSANE!! One store is not going to affect your property values. You should be happy that stores want to open in your area and you should welcome them.









Please illuminate or eliminate these city officials that cause us harm.
