May 13, 2011 PRESS RELEASE sent by the City of Bee Cave:

City of Bee Cave, Texas vs. AusPro Enterprises, L.P. d/b/a Plant K Texas (Michael Kleinman -owner)

During the Temporary injunction hearing before the Honorable Judge Livingston on May 5, 2011, Mr. Terry Irion, attorney for Michael Kleinman, and Phil Moncada, permitting consultant for Michael Kleinman, advised the court that Mr. Kleinman would comply with the City of Bee Cave ordinances and obtain required permits prior to any further construction activities at 12701 Highway 71 Westin Bee Cave. Due to these statements, the City of Bee Cave has decided to file a nonsuit (dismissal of lawsuit). We trust Mr. Kleinman will adhere to these statements by his representatives by submitting the required applications for permits. We look forward to working with Mr. Kleinman to resolve any further issues.
