Bee Cave City Council moves fast to stop Planet K

Bee Cave City Council, in a special session Monday night (April 4th) at 6pm, plans to consider numerous new ordinances to limit what Planet K can do in the City - at the old Trading Post building. See other stories HERE and HERE.
The agenda includes:
3. Discuss and consider action on Ordinance No. 76 amending Chapter 14, Offenses and Additional Provisions, of the City of Bee Cave Code of Ordinances, to create a new Article 14.04 related to the prohibited possession, use, ingestion, distribution, delivery and sale of certain synthetic cannabinoids, substances containing Methylenedioxypyrovalerone (MDPV), known as “Bath Salts”, restricting smoking materials and products considered drug paraphernalia providing for definitions, prohibited substances, restrictions on smoking materials and devices and creating penalties.
4. Discuss and consider action on Ordinance No. 77 amending Chapter 10 Business Regulations of the City of Bee Cave Code of Ordinances to create a new Article 6.07 Licensing Requirements for Sexually Oriented Businesses (“SOBs”) and creating fees and penalties.
5. Discuss and consider action on Ordinance No. 78 amending Chapter 24 Building Regulations, of the City of Bee Cave Code of Ordinances regarding information required to be submitted in building permit applications, building site requirements and additional criteria by which building permit applications will be evaluated by the Building Official and providing for penalties.
6. Discuss and consider action on Ordinance No. 79 amending Chapter 28 Sign Regulations of the City of Bee Cave Code of Ordinances to amend the definition of a sign and providing for penalties.
Executive Session. Executive session in accordance with the Texas Government Code, Section 551.071 - Consultation with Attorney in which the Attorney has a duty to the City under the Texas Disciplinary Rules of Professional Conduct that clearly conflicts with the provisions of the Open Meetings Law. The Council may adjourn into the Conference Room for the executive session.
A. LCRA Rate Case litigation
B. Consultation with attorney regarding authority of City of Bee Cave to:
1. regulate sexually oriented businesses and adult novelty businesses;
2. regulate drug paraphernalia, synthetic cannabinoids and other synthetic products used or ingested as a mind altering substance;
3. remedies available to the City for illegal construction activities in the City

I thought the idea was to go after stores selling this stuff, like planet k....not our citizens. Being parents of teens is tough enough. We don't want to ruin their futures by "criminalizing" possession of this stuff any more than the many laws already out there. The idea here is that we don't want it sold HERE, not to judge whether folks should be using it.
Target the sale....not the possession or use.

I appreciate the quick action by the Bee Cave City Council. While this decision has some "moral" elements to it there is a HUGE signal that Bee Cave is sending to the market that it will not tolerate things that bring down the "quality" & "value" of living in the Bee Cave & Lakeway areas.
Thank you for your quick action. Please make sure that no business of this type opens in our community.

I live in the Bee Cave area and would go to the shop, as well as know many others who would. If you don't want to go to it, don't. But don't pretend that there aren't people in this area that would go this store.

First, as much as we would not like to think, our children are already exposed to far worse than the items sold in a head shop. They are exposed to drug use, sex of all types, pornography and violence everyday on TV, the Internet and in movies at the Hill Country movie theater.
Secondly, laws, rules and regulations should not be passed in the heat of the moment. They should be thought about, considered and mulled-over. All laws, just like actions, have un-intended future consequnces (possibly expensive and long legal battles.)
And thirdly, remember that Bee Cave and Lakeway are not islands in and of themselves. One of the most liberal cities in Texas is just a few miles away. Though we should not become Austin, to pretend Bee Cave and Lakeway should mimic the conservative Pilgrim colony of the 1600's is just silly.
In conclusion, some of the reactions concerning the head shop remind me of the absolute hysteria that was caused several years ago in Midland, Texas, where I used to live. A gay man had died of AIDS and the local conservative newspaper had the courage to print the obituary with the name of his "life partner". One would have thought the newspaper printed photos of nude men and women! Why, gays did not live in Midland! And they certainly never had life partners!
So let's calm down people. Sensible, loving and intelligent people can make sensible and smart decisions that will stand the test of time.

2011-04-02 22:33:00 | RK - But they gave them a permit anyway.I find it amusing, actually, that the Bee Cave city council seems to be so disconnected, that they already gave Planet K a permit, without actually realizing what it was. It's getting built and with them already having a permit, there's not much anyone can do about it.
Which is good. To me, telling people what businesses they can and cannot open, on their own property because "someone feels it's not appropriate" is borderline communism.

Anyone with money in hand can buy everything and more than Planet K will ever sell in their brick and mortar store. Do you think your kids are dumb? While they're at it, why not just ban ANY & ALL type of wine &/or alchol, beer, or any substance that is related to alcholic drinks, AND also the "paraphenalia" that is used to make alcoholic drinks, including shakers, cork screws, etc..?? Alcohol has caused more deaths, abusiveness in relationships, broken lives, crime problems & many, many other types of societal misconduct & lives shattered, than anything that would be & is sold thru the Planet K stores!!! Bee Cave is SOOO behind the times of the 21st century!! Old people need to "wise up"!! Yes, there's a good reason that old ways die!! Planet K sells things that are verrry benign. Kids are exposed to many avenues that parents don't agree with. If YOU have raised them the best you can, then they will be just fine. Let's don't make Bee Cave a place where "commies" can make the "rules"!

Planet K breaks no current U.S. laws in any of the stores they have.It is sad that this is even being discussed in this country today.And yes I agree small local governments that think they have the right to pick and choose the businesses in the area they are suppose to govern does seem to have some communist elements to it.And in closing I really hope that this is not the same group that pushed for this multi million bankrupt mall we have here in high class Beecave.

2011-04-07 20:17:39 | kcr - This is embarrassingI posted this before but I am certainly not the target demographic for Planet K and am not thrilled about some of the perceived merchandise that they carry but I think the actions of the council in relation to the mural (among other actions) is embarrassing and damaging to our community. This IS the Austin area for goodness sake and I think that we want other creative, fun and original businesses in the area (like the cupcake trailer). By banning murals this makes us Round Rock. Communities that embrace creativity result in desirability and in higher property values when guided by the city-- but not banned (think Nantucket, Laguna Beach, etc.). This action makes me reconsider where I want to buy my next house and spend my dollars moving forward. By the way, I really love the mural and think we missed an opportunity. Is it too late for the council to reconsider their actions?
